Your privacy is of great importance to Gain.pro B.V. (Gain.pro’). During the processing of personal data Gain.pro operates conform the requirements of the applicable data protection legislation, like the General Data Protection Regulation (‘GDPR’). This means we:


  • Clearly specify our purposes before we process personal data, by using this privacy and cookie statement.

  • Limit our collection of personal data to only the personal data needed for legitimate purposes.

  • First ask for explicit permission to process your personal data in cases where your permission is required.

  • Take appropriate security measures to protect your personal data and we demand the same from parties who process personal data on our behalf.

  • Respect your right to access, correct or delete your personal data held by us.


Gain.pro is the party responsible for all data processing. In this privacy and cookie statement, we will explain what kind of personal data we collect and for which purposes within our website Gain.pro. We recommend that you read it carefully.

Website

On our website we process personal data. The following points explain what personal data we process and why.


Contact forms and chat
You can use our contact form or the chat on the website to ask questions or make a request for a demo, pricing, a trial or a chat. For this purpose, we use your:


  • Name (first name and surname) 

  • Work email address

  • Job title

  • Company name

  • Country/region

  • Other personal information that you provide.


We need this data because of our agreement with you. We store this information until we are sure that you are satisfied with our response and 60 months thereafter. This way we can easily access the information in case you have any following questions and train our customer service to improve even more.



Newsletter

We provide a newsletter that we send out 1 times per week to inform those interested about our latest news, updates and information about our services. For this purpose, we use your:


  • Name (first name and surname) 

  • Company e-mail address


We process this data based on your consent. We store this information until you cancel your subscription. You may cancel your subscription to our newsletter at any time. Each newsletter contains a link to unsubscribe from our newsletter. 


Apply for a job

You can apply for a job at Gain.pro. On our website you can find several vacancies at our different Gain.pro locations. You can apply for a job in different ways. You can apply by filling in the application form. When you fill in the application form, we process the following data: 


  • Resume or CV

  • Name (first name and surname) 

  • LinkedIn profile (optional)

  • Employment history

  • Educational background

  • Skillset

  • E-mail address

  • Phone number

  • Any personal data you mention in your motivation letter (optional)


We need this information to contact you regarding your application and assess your suitability for the role.


We may also collect personal data from third-party recruiters and publicly available sources. Data may be transferred to countries outside the European Economic Area (EEA) where appropriate safeguards are in place.


Your personal data will not be disclosed to third parties except for the following recipients:


  • Gain.pro B.V. subsidiaries: Your data may be shared with other Gain.pro entities during the recruitment process.

  • Third-party service providers: This includes HR software and IT service providers. We require these third parties to implement appropriate technical and organizational measures to protect your resume or CV data.


If your application is successful, your personal data will also be used to manage your employment relationship, including administering payroll, benefits, and performance management.


In case you are not hired, your personal data will be deleted within four months of the end of the application procedure that you are involved in, unless the law obliges Gain.pro to store the data for longer. If Gain.pro does wish to retain your data within its portfolio for a longer period, we will ask your permission to do so. We ask for this permission so we can contact you when we have a different vacancy which is applicable to you. If you have given your permission, we will retain your personal data for a maximum of two years after the end of the application procedure.



Web app and add-ins

Providing your personal data in our tool to make it findable to our customers

We may collect your personal data as part of the services we offer to our customers. To do so, we process the following personal data:


  • Name (first name and surname) 

  • Age

  • Email address

  • Current location

  • Function title at your current job

  • LinkedIn URL

  • Current company name

  • Current company website

  • Educational background

  • Professional work experience

  • Nationality

  • Deal-related information (including roles in deal-making, such as advisors)


We collect and process your personal data based on our legitimate interest as a legal basis. Our legitimate interest stems from our core service of facilitating business transactions and networking opportunities within the Private Equity and M&A ecosystem. Our customers, including investors, advisors, lenders, lawyers, and executive search firms, rely on accurate and comprehensive information about professionals in privately held companies to make informed business decisions and identify potential deal opportunities.

Our platform provides our customers with the ability to identify and connect with relevant business professionals, which is essential for deal-making in the Private Equity and M&A sector. By processing your personal data, we enable efficient networking between qualified business professionals and our customers, leading to potential business opportunities, investments, and transactions.

We collect this data through various sources, including public sources, involved parties, and third parties, and we also purchase bulks of (personal) data. The personal data we process is organized in a structured manner to facilitate meaningful business connections. While this information is publicly available, our service adds value by efficiently organizing and presenting this data to enable our customers to identify and connect with relevant business professionals. This processing benefits both our customers, who can more efficiently identify potential business partners, and the professionals whose data we process, as they may receive relevant business proposals and deal opportunities from our network of customers within the Private Equity and M&A ecosystem.

We maintain appropriate safeguards to protect your privacy rights and ensure that the processing of your personal data is proportionate to achieving these legitimate business purposes.

We store this information for a period of 3 years after you leave the position or your employment ends.


Handling your order and use of our services
We use your personal data when handling your order. For this purpose, we use your:


  • Name (first name and surname)

  • Corporate address

  • Phone number

  • Invoice address

  • Email address

  • Payment details


We need this data because of our agreement with you. We store this information for 7 years after your order has been completed. Certain types of personal data will be retained for a longer period with regards to the legal tax retention.


Furthermore, we may process additional personal data to improve and protect our services. We collect and process your personal data based on our legitimate interest as a legal basis. For this purpose, we may you use your:


  • Account information

  • Information about how you use our services


In order to use our service we require you to register. You will have to provide some extra information about yourself and choose a username and password for your account. For this purpose, we need the following additional information:


  • Name (first name and surname) 

  • Work email address (username)

  • Password     

  • IP-address


We process this data in order to execute the Agreement. We keep this data for 60 months after you terminate your account. Certain types of personal data will be retained for a longer period in order to comply with the tax retention period.  


Chrome Extension

We need your work email for purposes of logging into the chrome extension application. The extension also captures anonymized session activity by keeping count of companies, investors and the industries viewed.  For this purpose, we may use your:


  • Work email address (username)

  • Password

  • Session activity


We process this data in order to execute the Agreement. We keep this data for 60 months after you terminate your account. Certain types of personal data will be retained for a longer period in order to comply with the tax retention period.  



General

Providing data to third parties

We share your personal data with third parties only when permitted by current law. We may provide your personal data to third parties because:


  • We have engaged them to process certain data

  • It is necessary to execute the agreement with you

  • You give permission for this

  • We have a legitimate interest in doing so

  • We are legally obliged to do so (for example, if the police require this in case of suspicion of a crime)


To deliver you the services we mentioned above we share your data with: 


  • Cloud computing services

  • Website infrastructure providers

  • Data storage service providers

Enabling and disabling cookies

Deleting cookies

We renew our security measures to ensure safe storage of personal data and keep track of what might go wrong. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorised third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, the transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.


Changes to this privacy and cookie statement 
We reserve the right to modify this statement. We recommend that you consult this statement on a regular basis, so that you remain informed of any changes. 


Do we collect information from minors?

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. Inspection and modification of your data 
You can always contact us if you have any questions regarding our privacy policy or wish to review, modify or delete your personal data. You have the following rights: 


  • Right of access: you have the right to see what kind of personal data we processed about you. 

  • Right of rectification: you have the right to rectify any personal data we have processed about you, if this information is (partially) wrong. 

  • Right to complain: you have the right to file a complaint against the processing of your personal data by us, or against direct marketing. 

  • Right to be forgotten: you can file a request with us to remove any personal data we have processed of you. 

  • Right to withdraw consent: if you have given us your consent to process personal data, you may withdraw this consent at any time. 

  • Right to data portability: if technically possible, you have the right to ask us to transfer your processed personal data to a third party. 

  • Right to restriction of processing: you can file a request with us to (temporarily) restrict the processing of your personal data. 


If you exercise any of the rights mentioned above, we might ask to identify yourself with a valid ID, to confirm it is your personal data. If so, it is important that you hide your social security number and photo.


You can exercise your rights by sending an email to privacy@gain.pro or by visiting our 'Do Not Sell My Information' page. On this page, you can also opt out of the processing of your personal data for our services.


We will usually respond to your request within one month. This term can be extended with a maximum of two months if the request is proven to be complex or tied to a specific right. You will be notified about a possible extension of this term.


Complaints 
If you want to file a complaint about our use of personal data, please send an e-mail with the details of your complaint to privacy@gain.pro. We will look into and respond to any complaint we receive.
